FOG CUTTER CAPITAL GROUP INC. ANNOUNCES SALE OF INDUSTRIAL LAND

PORTLAND, Oregon.— October 13, 2003 -- Fog Cutter Capital Group Inc. (Nasdaq: FCCG) has completed the sale of two finished industrial lots located in the city of Irwindale, California. The two parcels total 227,863 square feet, or 5.2 acres, and are fully improved with paved streets, streetlights, curbs, gutters and utilities. Irwindale is located at the center of the San Gabriel Valley between the inland empire region and downtown Los Angeles. The property has convenient access to Interstate Route 210 and Interstate Route 605.

The land was originally acquired by Fog Cutter in November 1998 as part of a $3.2 million purchase of a 15 acre industrial park. In 2000, the Company sold approximately 10 acres for cash to a Southern California developer at a gain of $0.4 million. The same developer was also the buyer of the remaining five acres. Fog Cutter provided financing to the buyer and expects to defer the recognition of most of the approximate $0.8 million in income from the transaction until October 2004, when the loan is scheduled to be repaid.

Fog Cutter Capital Group Inc. focuses on investing, structuring and managing a wide range of financial assets, including the acquisition of debt or equity positions in companies requiring assistance in restructuring their operations; investments in mortgage-backed securities; provision of corporate mezzanine financing and other similar investments. The Company recently announced the completion of a $6 million investment and financing package for Fatburger Holdings, Inc. (“Fatburger”). Fatburger operates or franchises 51 hamburger stands located in California, Nevada, Arizona and Washington. The company has plans to open an additional 124 restaurants including expansion into Oregon, Louisiana, Colorado, Georgia, Ohio, New Jersey, Florida, and Michigan. Known for their cook to order gourmet hamburgers, the 50's-style restaurants also offer a variety of side orders and other sandwiches, including turkey and chicken. Franchisees own and operate about half of the company's locations. In 1952, Lovie Yancey opened the first Fatburger stand in Los Angeles when "fat" was used as slang for "good." There are more than 500 employees working at various company owned and franchise locations. Fog Cutter’s investment and financing package for Fatburger included the purchase of common stock and redeemable preferred stock.
